FIRESTONE DIRECT MEET MARIO CONTEST
Official Rules
PURCHASE REQUIRED.
INTERNET ACCESS AND VALID E-MAIL ADDRESS REQUIRED.
Sponsor: Bridgestone Retail Operations, LLC, 200 4th Avenue S., Nashville, TN 37201.
Open only to persons who reside within approximately a (45) minute drive of Nashville, Tennessee (including, Ashland City, Goodlettsville and Mt. Juliet, Tennessee) who are 18 years or older who own or lease a car. Contest is offered only within approximately a (45) minute drive of Nashville, Tennessee and is void elsewhere and where prohibited by law.
Employees, officers, directors and independent contractors of Sponsor, its parent, divisions, subsidiaries, affiliated companies (including Firestone Complete Auto Care locations), direct competitors of Firestone Complete Auto Care (including entities providing vehicle repair or warranty-related services), advertising and promotional agencies, the management and representation of Mr. Mario Andretti, their immediate family members (defined as parents, children, siblings, spouse), regardless of where they live, and members of their same household (whether related or not) are NOT eligible to enter or win the prize.
By participating, you agree to abide and be bound by these Official Rules and Sponsor’s decisions, which are final and binding in all respects and are not subject to appeal. Without limitation, you agree that Sponsor’s determination of the correct answers to the trivia questions (as discussed below) regarding Mario Andretti’s racing career are final and binding in all respects and are not subject to appeal.
1. HOW TO ENTER.
a. From July 18, 2022 at 12:00:01 a.m. through August 3, 2022 at 9:00:00 a.m., schedule a vehicle service appointment with Firestone Direct online for Thursday, August 4, 2022. Should all service appointments for August 4 be scheduled prior to 9:00:00 a.m. on August 3, the Contest will end at that time and no further entries will be accepted.
b. Correctly answer all (3) trivia questions regarding Mario Andretti’s racing career.
c. In an original statement of no more than (80) words, tell us why it would be meaningful for you to meet racing legend Mr. Andretti.
d. Before entering the Contest, you are advised to review Sponsor’s privacy policy at https://www.firestonedirect.com/privacypolicy to learn how Sponsor will use and share personal information collected from you when entering.
2. ENTRY RESTRICTIONS.
a. Limit of one (1) entry per person.
b. Statement must be included in designated areas of vehicle service appointment ticket and submitted in same online session as service appointment ticket.
c. Once submitted, statement and answers to trivia questions cannot be modified or altered in any way.
d. Use of automated, programmed or similar means of entry, as well as third party sweepstakes/contest entry services, is prohibited.
e. Proof of submission of service appointment ticket does not constitute proof of receipt of same or proof of entry in the Contest.
f. Receipt of entry will be acknowledged by Sponsor, but this acknowledgment does not constitute any representation as to eligibility for the Contest.
g. Cancellation of appointment or if consumer is not available for vehicle service appointment at scheduled time for any reason voids entry.
h. If you enter via mobile device, you will be responsible for wireless Internet access and other charges of wireless carrier. Wireless Internet access is not available in all areas.
i. Sponsor shall resolve disputes as to identity of entrant in its sole discretion. Without limitation, the person who schedules the appointment for Firestone Direct vehicle repair services shall be considered the entrant regardless whether he/she owns the vehicle in question or is paying the vehicle repair costs.
3. ENTRY RESTRICTIONS: CONTENT OF STATEMENT.
Sponsor will disqualify entry if it determines that statement violates one or more of the following restrictions:
a. Statement is not entirely original and violates or infringes upon the rights of any party (including copyright, trademark, right of privacy, right of publicity), including the rights of third party entities. {For clarity, referencing Mr. Andretti does not constitute a violation of this restriction.}
b. Statement is inappropriate, profane, vulgar, obscene or otherwise unfit for publication.
c. Statement includes any content which disparages or ridicules persons based on gender, religion, race, ethnicity, national origin, sexual orientation or identification, or any other defining characteristic.
d. Statement advocates the use of alcohol or drugs, acts of violence, dangerous stunts, aggressive or reckless behavior or illegal conduct of any kind (including but not limited to driving under the influence/drinking and driving).
e. Statement addresses politics, religion or any other controversial subject.
f. Statement is not truthful.
g. Statement disparages or damages the goodwill or business reputation of Sponsor, its Firestone Direct service or defames, maligns or insults Mr. Andretti or his family.
4. DETERMINATION OF WINNER.
a. The judging panel will evaluate statements based on originality (25%); creativity (25%) and extent of enthusiasm and interest in meeting Mario Andretti (50%). In the unlikely event of a tie, the winner will be the tied entrant who had the higher/highest score in the criterion of extent of enthusiasm and interest in meeting Mario Andretti (50%). The judging will take place on or about August 3, 2022.
5. PRIZE
a. PRIZE (1) – Mario Andretti will meet and greet the winner and up to (5) guests during his/her/their Firestone Direct service appointment on August 4, 2022. Winner will also receive one (1) Firestone Direct checkered flag, autographed by Mario Andretti, with an approximate retail value of $75. Approximate retail value of autographed checkered flag does not represent its re-sale value. Sponsor will not provide a certificate of authenticity with autographed checkered flag. {.
b. Potential winner will NOT be notified prior to receipt of Prize: winner will learn of his/her/their receipt of Prize at time of corresponding Firestone Direct service appointment. Late cancellation of appointment or if potential winner is a “no show” for appointment (as per the standard terms and conditions of sale of Firestone Direct services) will result in prize forfeiture without compensation of any kind and, in such case, Sponsor may but is in no way obligated to award the prize to an alternate winner selected from among all remaining eligible entries received, time permitting.
c. Potential winner may be required to sign and return a Declaration of Eligibility & Liability Release at time of prize award.
d. The meeting with Mr. Andretti will last a minimum of (15) minutes. Mr. Andretti may not remain for entirety of Firestone Direct service appointment, nor will Mr. Andretti render any vehicle repair or maintenance services or advice.
e. In addition to the autographed checkered flag, Mr. Andretti will sign autographs and pose for “selfie” videos/photos with winner and guests at his sole discretion. Recordation of meet and greet with Mr. Andretti (other than “selfies,” to the extent authorized by Mr. Andretti) is subject to the prior approval of Sponsor and Mr. Andretti in their sole discretion.
f. Sponsor WILL record the meet and greet of winner and Mr. Andretti. As between winner (and guests) on the one hand, and Sponsor on the other, Sponsor shall own any and all right, title and interest in and to such recordation of the meet and greet. Winner (and guests), upon Sponsor’s request and without compensation, agree to sign any documentation that Sponsor may require so as to confirm, record, perfect or effect such ownership rights in the recordation of the meet and greet. Sponsor will only make commercial use of the recordation of the meet and greet with the consent of the winner (and guests) which may be granted or withheld in his/her/their sole discretion. If withheld by winner (and guest[s]), Sponsor may still use the recordation of the meet and greet for commercial purposes with winner and guest(s), as applicable, not being included therein. Regardless of whether (or not) winner and guest(s) provide his/her/their consent, Sponsor (i) will retain the recordation of the meet and greet for internal and archival purposes and (ii) is in no way obligated to make any use of the recordation of the meet and greet with the understanding that Sponsor (as well as Mr. Andretti) will have no liability in conjunction with refraining from using same.
g. Award of meet and greet with Mr. Andretti may be conditioned by Sponsor upon compliance with one or more of the following protocols so as to prevent the spread of COVID-19/Coronavirus:
· Taking a COVID-19/Coronavirus test which yields a negative result;
· Providing adequate proof of being fully vaccinated (with booster) against COVID-19/Coronavirus;
· Completion of a health questionnaire as to whether one has experienced symptoms of COVID-19/Coronavirus;
· Hand-sanitizing prior to shaking hands/coming into physical contact with Mr. Andretti;
· Adherence to social distancing requirements (regardless of one’s vaccination status);
· Adherence to mask wearing requirements (regardless of one’s vaccination status).
Winner and guests further understand and agree that:
· Mr. Andretti reserves the right to wear a mask and/or to engage in social distancing during the meet and greet;
· Sponsor has not obtained any health or other insurance in conjunction with the meet and greet.
h. Winner and guests must conduct themselves at all times in a socially responsible, respectful and appropriate manner toward Mr. Andretti (as well as Firestone Direct mechanics). Without limitation, winner must NOT (i) be intoxicated or under the influence of drugs; or (ii) smoke tobacco or e-cigarettes/vape during meet and greet. In addition, insulting, threatening, antagonizing or taunting Mr. Andretti (and/or Firestone Direct mechanics) will NOT be tolerated. MEET AND GREET WILL BE CANCELLED, PERHAPS WITHOUT WARNING, IF WINNER AND/OR GUESTS FAIL TO CONDUCT THEMSELVES APPROPRIATELY. SHOULD THE MEET AND GREET BE CANCELLED FOR THIS REASON, SPONSOR AND MR. ANDRETTI WILL NOT HAVE ANY LIABILITY TO WINNER (OR HIS/HER GUESTS), WITH THE CHECKERED FLAG ELEMENT OF PRIZE ALSO BEING FORFEITED BY WINNER. IF CONDUCT BY WINNER AND/OR GUESTS IS DEEMED BY SPONSOR AND/OR MR. ANDRETTI TO BE PARTICULARLY EGREGIOUS OR REPEATED, SERVICE APPOINTMENT MAY BE CANCELLED WITH FULL PAYMENT STILL BEING DUE. SPONSOR AND MR. ANDRETTI FURTHER RESERVE THE RIGHT TO PURSUE LEGAL SANCTIONS AGAINST WINNER AND/OR HIS/HER GUESTS SO AS TO PROTECT THEIR RESPECTIVE RIGHTS.
i. Should Sponsor not be able to award prize due to unforeseen circumstances (e.g., modification to applicable U.S. Federal, Tennessee State, County or Local health regulations/mandates; other government action; the health of Mr. Andretti; natural cataclysm; riot; strike; civil commotion), Sponsor shall not have any liability of any kind to winner under any legal theory other than award of checkered flag element of prize. See also Rule 7 below.
j. Award of prize has no bearing on the Firestone Direct mechanics’ rendering of vehicle repair services. The standard terms and conditions of sale of Firestone Direct services apply at all times, notwithstanding award of prize.
k. Prize must be accepted as awarded. No prize substitution or cash redemption is allowed by winner. Prize is not transferable.
l. All unspecified expenses in conjunction with acceptance and use of prize as well as any applicable taxes on value of prize are the winner’s sole responsibility.
6. LIMITATIONS OF LIABILITY.
a. Sponsor assumes no liability or responsibility for late, lost, illegible/garbled, corrupted, incomplete, inaccessible/blocked, jumbled, damaged or misdirected entries (all of which are void) or for technological, programming, electronic or other malfunction, failure or error of any kind.
b. In participating in the Contest, you understand and agree that your answers to trivia questions and statement as well as those of other Entrants are proprietary and confidential information of Sponsor and you waive any right to review same.
c. Sponsor disclaims any and all liability for any error in advertising or offering the Contest.
d. Sponsor’s failure to enforce any provision of these Official Rules on a given occasion will not constitute the waiver of such provision.
e. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or Twitter.
7. FORCE MAJEURE. If the Contest cannot be conducted as originally planned due to any cause beyond Sponsor’s control, Sponsor may cancel, suspend, or modify the Contest (in whole or in part) and conduct the Contest, making the prize available in a manner which is determined by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules. Notice of such action by Sponsor will be posted at www.firestonedirect.com/promotions.
8. RELEASE OF LIABILITY. By participating in the Contest, an entrant indemnifies, releases and agrees to hold harmless
(i) Sponsor;
(ii) its parent, divisions, subsidiaries, affiliated companies, advertising and promotional agencies;
(iii) Mr. Mario Andretti as well as his management and representation;
(iv) the employees, officers, directors, representatives, agents, shareholders, successors and assigns of any of the foregoing organizations; and
(v) Metas Platforms, Inc. and Twitter, Inc.
from any and all liability or injury arising directly or indirectly, in whole or in part from participation in the Contest, participation in any Contest-related activity or acceptance, possession, receipt, use or misuse of the prize.
9. TAMPERING. Attempting to tamper with/attempting to undermine the intended operation of the Contest; violation of these Official Rules; or any attempt to defraud Sponsor in conjunction with the Contest will result in disqualification from Contest. Beyond the preceding, Sponsor as well as Mr. Andretti each reserve the right to pursue all other available legal remedies to the fullest extent of the law.
10. DISPUTES.
a. All entrants agree that any dispute regarding the Contest or these Official Rules will be brought in the U.S. Federal or State courts in Davidson County, Tennessee and irrevocably waive any claim or defense that such court does not have personal jurisdiction over entrant or that it is an inconvenient forum for resolving such dispute.
b. All entrants further agree, to the fullest extent permitted by law, that any dispute will be brought individually and not as part of a class action within one (1) year after such cause of action arose (with it thereafter being forever barred) and that their recovery in same will be limited to actual out-of-pocket costs incurred in participating in Contest, with the right to any other damages (including but not limited to incidental, compensatory, consequential and punitive damages), equitable relief or other remedy of any kind as well as attorneys’ fees being expressly waived.
c. All entrants further agree that any dispute regarding the Contest or these Official Rules will be resolved pursuant to the laws of the State of Tennessee without regard to conflict of law or choice of law provisions.
11. WINNER’S LIST. Name of winner (first name, last initial, city) is available by sending a self-addressed stamped envelope to Sponsor at the address for receipt by August 10, 2022.
