Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

Lincolnshire Swim Club (“LSC”) has put in place preventative measures to reduce the spread of COVID-19; however, LSC cannot guarantee that you, your spouse or your child(ren) will not become infected with COVID-19. Further, attending LSC could increase your risk, your spouse’s and your child(ren)’s risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my family and I may be exposed to or infected by COVID-19 by attending LSC and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at LSC may result from the actions, omissions, or negligence of myself and others, including, but not limited to, LSC employees, officers, directors, volunteers, agents, representatives, participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to or damages suffered by my family or myself including, but not limited to, illness, personal injury, disability, and death, and any damages, losses, claims, liability, or expenses, of any kind, that I or my family may experience or incur in connection with or as a result of our attendance at LSC or participation in LSC activities (all of the forgoing being referred to as the “Claims”). On my behalf, and on behalf of my family, I hereby release, discharge, and hold harmless LSC, and covenant not to sue LSC and its employees, officers, directors, volunteers, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating to the Claims. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of LSC, its employees, officers, directors, volunteers, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any LSC activity.

Also, in submitting this registration I waive, release, and forever discharge LSC and its employees, officers, directors, volunteers, agents, and representatives for and from any and all injuries, losses, and other damages suffered by my spouse or child or ward or us at LSC, and agree to hold LSC and its employees, officers, directors, volunteers, agents, and representatives harmless from and against any and all claims, demands, including reasonable attorneys’ fees, made by any third party, to the members of my family, including any of my children or wards, due to or arising out of my family, child or ward’s use of LSC.  I acknowledge that using LSC poses risks for my child or ward, and I represent that my child or ward is physically able use LSC and has trained sufficiently to do so.
