  • energy suppliers
  • scheme administrators
  • non-domestic energy customers

The Energy Bill Relief Scheme Regulations 2022 and the Energy Bill Relief Scheme (Northern Ireland) Regulations 2022 came into force on 1 November (with minor amendments made by the Energy Bill Relief Scheme and Energy Price Guarantee Pass-through Requirement and Miscellaneous Amendments Regulations 2022 (coming into force shortly afterwards on 5 November 2022).

The regulations were made under powers in the Energy Prices Act 2022. This legislation provides government with the powers to establish the scheme, ensure benefits are passed on to consumers and provide for an effective compliance and enforcement regime.

The rules and documents on this page are made and published pursuant to the above regulations.

The Pass Through Requirement Regulations ensure that intermediaries, such as landlords, who have received energy price support, including from the Energy Bill Relief Scheme, pass through the benefit obtained to end users - see the Pass-through requirements guidance.

Energy Bill Relief Scheme Rules for Great Britain (GB) and Northern Ireland (NI)

These Rules are made pursuant to the Energy Bill Relief Scheme Regulations. The Rules will be updated in accordance with the Regulations.

For the GB scheme:

  • Energy Bill Relief Scheme (No.2) Rules 2022. These are amended by
    • Energy Bill Relief Scheme No. 2 (Amendment) Rules 2022 and
    • Energy Bill Relief Scheme (No. 2) (Amendment No. 2) Rules 2022 and
    • Energy Bill Relief Scheme (No.2) (Amendment No.3) Rules 2022
    • Energy Bill Relief Scheme (No.2) (Amendment) Rules 2023

For the NI scheme:

  • Energy Bill Relief Scheme (No.2) (Northern Ireland) Rules 2022. These are amended by
    • Energy Bill Relief Scheme (Northern Ireland) No. 2 (Amendment) Rules 2022 and
    • Energy Bill Relief Scheme (Northern Ireland) (No. 2) (Amendment No. 2) Rules 2022 and
    • Energy Bill Relief Scheme (Northern Ireland) (No.2) (Amendment No.3) Rules 2022
    • Energy Bill Relief Scheme (Northern Ireland) (No.2) (Amendment) Rules 2023

Details of each document

Energy Bill Relief Scheme (No.2) Rules 2022 (and equivalent rules for Northern Ireland)

These Rules set out:

  • separating flexible rate contracts into components for (i) intermediaries; (ii) multi-site customers; and (iii) customers involved in providing balancing services
  • Combined Heat and Power (CHP) plants under 5 megawatts of generating capacity

Energy Bill Relief Scheme (No. 2) (Amendment) Rules 2022 (and equivalent rules for Northern Ireland)

These amend the Energy Bill Relief Scheme (No.2) Rules 2022 to include the process for discount recovery for eligible non-domestic energy suppliers in Great Britain and Northern Ireland.

The Energy Bill Relief Scheme (No.2) (Amendment No. 2) Rules 2022 (and equivalent rules for Northern Ireland)

These amend the Energy Bill Relief Scheme (No. 2) Rules 2022 to set out:

  • certain dispute resolution procedures in relation to the Energy Bill Relief Scheme
  • how suppliers will be required to treat certain financially disadvantaged customers in relation to their supply contracts

The Energy Bill Relief Scheme (No.2) (Amendment No.3) Rules 2022 (and equivalent Rules for Northern Ireland)

These amend the Energy Bill Relief Scheme (No.2) Rules 2022 by replacing a formula to calculate the ‘relevant percentage’ for the purposes of reducing certain energy supply costs for Qualifying Financially Disadvantaged Customers.

The amendment that inserted the provisions about Qualifying Disadvantaged Customers into the Energy Bill Relief Scheme (No.2) Rules 2022 is in the Energy Bill Relief Scheme (No.2) (Amendment No.2) Rules 2022.

Energy Bill Relief Scheme (No.2) (Amendment) Rules 2023 (and equivalent Rules for Northern Ireland)

These amend the Energy Bill Relief Scheme (No.2) Rules 2022 by substituting a new Schedule 1 for the Schedule 1 inserted by Schedule 2 to the Energy Bill Relief Scheme (No.2) (Amendment) Rules 2022 (and their respective Northern Ireland equivalents). The effect of the new Schedule 1 is to require suppliers to provide a number of additional pieces of information when making discount recovery claims.

Energy Bill Relief Scheme Government Supported Price and Maximum Discount

These documents set out the Government Supported Price and the Maximum Discount under the Energy Bill Relief Scheme. Each document applies only to the relevant administration.

Energy Bill Relief Scheme Reference Wholesale Price Methodology

These documents detail the methodology used for determining reference wholesale prices applicable to variable price contracts and fixed price contracts for the Energy Bill Relief Scheme. Each document applies only to the relevant administration.
